By accessing or using ShellArmor ("the Service"), operated by Averta Security ("we", "us", "our"), you ("Customer", "you") agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree, do not use the Service.
ShellArmor is a security platform that provides real-time SSH session protection for Linux servers. The Service consists of:
The Service is designed to protect servers you own or are authorized to manage. We do not guarantee the prevention of all security incidents.
You must provide accurate, current, and complete registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend accounts with inaccurate registration information.
Free Plan: Available for one (1) host at no charge, subject to feature limitations described on our pricing page.
Pro Plan: Billed monthly at the per-server rate published on our pricing page. Charges are calculated based on the number of active servers connected to the Service during the billing period.
Enterprise Plan: Custom pricing as agreed in a separate order form or agreement. Enterprise terms may supplement or override portions of these Terms.
Add-ons: Optional add-on features are billed monthly per server at the rates published on our pricing page.
Payment: All paid plans are billed in advance on a monthly basis. Payments are processed through our third-party payment providers (Stripe, PayPal). You authorize us to charge your selected payment method for all applicable fees. Prices are subject to change with thirty (30) days' prior notice.
Refunds: Fees are non-refundable except as required by applicable law. If you cancel mid-cycle, you retain access until the end of the current billing period.
You agree to use the Service only for lawful purposes and only on servers you own or have explicit authorization to manage. You agree not to:
The ShellArmor agent collects security-relevant data from your servers including: SSH session metadata (source IPs, usernames, timestamps), command patterns and threat scores, file integrity events, authentication events, and system health information. This data is transmitted to our infrastructure over encrypted channels and processed to provide the Service. Our Privacy Policy describes in detail what data we collect, how we use it, and how we protect it.
You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including providing any required notices to users whose sessions may be monitored.
Security event data is retained according to your subscription plan:
Upon account termination, your data is retained for thirty (30) days to allow for export, after which it is permanently deleted. You may request data export at any time through the dashboard or by contacting support.
We strive to maintain high availability of the dashboard and API. Enterprise customers receive SLA commitments as specified in their order form. The agent operates independently on your servers and continues to enforce policies even if connectivity to our dashboard is temporarily lost.
We may perform scheduled maintenance with reasonable advance notice. We are not liable for unavailability caused by factors outside our reasonable control, including internet outages, force majeure events, or third-party service failures.
We implement industry-standard security measures to protect the Service and your data, including TLS 1.3 encryption in transit, AES-256 encryption at rest, and mutual TLS for agent-to-dashboard communication. However, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security and are not liable for any unauthorized access resulting from factors beyond our reasonable control.
The Service, including the agent software, dashboard, APIs, documentation, and all related intellectual property, is and remains the exclusive property of Averta Security. These Terms do not grant you any rights to our trademarks, logos, or brand features.
You retain all rights to your data. You grant us a limited license to process your data solely to provide and improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THAT THE SERVICE WILL DETECT OR PREVENT ALL SECURITY THREATS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AVERTA SECURITY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, BUSINESS INTERRUPTION, SECURITY BREACHES, OR UNAUTHORIZED ACCESS TO YOUR SERVERS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Averta Security and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your installation of the agent on servers without proper authorization.
By you: You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period. You are responsible for uninstalling the agent from your servers.
By us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees when due, or if we reasonably believe your use poses a security risk to the Service or other customers. We will provide notice where practicable.
Effect of termination: Upon termination, your right to use the Service ceases immediately. Your data will be retained for thirty (30) days for export purposes, after which it will be permanently deleted.
We may modify the Service at any time, including adding or removing features. We will provide reasonable notice of material changes that negatively affect your use of the Service.
We may update these Terms from time to time. We will notify you of material changes via email or dashboard notification at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the effective date.
These Terms are governed by the laws of the jurisdiction in which Averta Security is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations or unauthorized access to the Service.
Entire Agreement: These Terms, together with the Privacy Policy and any applicable order form, constitute the entire agreement between you and Averta Security regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure: We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemic, power outages, or internet disruptions.
